As we are dealing with 2000 years of waiting by humanity for the expected one, it is a tall order to claim being that one. Therefore, God has blessed me with enough titles in order to instill confidence within me. But i am not Jesus of Nazareth as some spirits think i am.
Through this Rhema just a few days ago, I am rather Son of Jesus, heir to everything Jesus owns.
Also, it is not Jesus who will judge, but rather another who will judge based on the Words of Jesus (see John 12:47-48). This judge could be Father God or this adopted Son of Jesus. If Father God is the judge, there will be a conflict of interest because Father and Son are one party. A neutral person is required to judge Satan, his angels and all who follow him. Therefore, the expected one has to be this adopted one.
“Indeed the Father has committed all judgement to the Son (Lord Jesus Christ)” (John 5:22).
But note these Words of the Lord:
“If anyone hears my (Jesus Christ of Nazareth) words but does not keep them, I do not judge that person. For I did not come to judge the world, but to save the world. There is a judge (yours truly) for the one who rejects me (Jesus Christ of Nazareth) and does not accept my words; the very words I have spoken will condemn them at the last day. (John 12:47-48 NIV)
Neither the Father nor the natural Son (Jesus of Nazareth, Son of Virgin Mary) will undertake the judgement because of conflict of interest.
God has waited six thousand years to judge Satan and his angels. It is not without reason that there is such a long wait.
The reason: Conflict of Interest!
I am not a self-proclaimed judge of the world. I am just a Software Engineer, who has been yanked out of my profession and made Immanuel, Son of David, etc.
Conflict of interest is “a situation in which a person is in a position to derive personal benefit from actions or decisions made in their official capacity.” (Oxford dictionary)
Conflict of Interest w.r.t God
God’s archenemy is Satan. But God does not take unilateral decision to destroy Satan. The Law of Conflict of Interest that He gave through Moses and upheld by the Son was that there be present at least two or three witnesses to bind or loose someone (Hebrews 10:28; Matthew 18:16).
God waited six thousand years to judge Satan and his followers. God applies that same Law to Himself as well (praise the Lord!). God, Son and Holy Spirit are one party. A conflict of interest would arise if any of them is judge. Therefore, a 100% human is needed to judge Satan and all his followers, without there being any conflict of interest. It turns out that yours truly was chosen and given that honor. But the Judge really is the Law itself. “The very words I (Lord Jesus Christ) have spoken will condemn them at the last day.” (John 12:48b NIV)
In view of Luke 12:47-48; Hebrews 10:26-31; Colossians 1:24; Hebrews 9:22; John 20:21-23, i have invented a solution for absolving Willful Sin–a remedy from being cast into hell for sons and daughters of God in particular (Matthew 8:11-12).
At the outset, Salvation is only through Jesus and not through any other God. Jesus is the way the truth and the life, no one comes to the Father except through the Lord Jesus Christ (John 14:6).
This Precursor to Fire Baptism is also a proclamation about the veracity of hell to the whole wide world.
After being born-again and baptized, God is engineering our divinity (sanctification):
Once we are born-again, we are not immediately translated to heaven–we remain in this body, the “tent.” Due to inertia, we do sin inadvertently/unknowingly, for which we can avail the sacrifice of Jesus Christ at the time of keeping short accounts with God and introspection around the Lord’s Table (Breaking of Bread & Foot-washing).
Since repentance is a condition for receiving forgiveness, only our “former sins” (Romans 3:25), that is, our “past sins” (2 Peter 1:9) before the time of being born-again, are forgiven. Sinning unknowingly or inadvertantly are also considered as past sins for which one can avail the blood of Christ because opportunity for conscious repentance has yet to be given for those sins. You see, there is no such thing as “inexhaustible source of salvation” (Pope Francis) nor any promise of “inexhaustible, blood-bought, Christ-exalting future grace” (Dr. John Piper). Our Lord Jesus was in the belly of the earth only for a fixed period of three days and three nights to pay for our sins during a fixed period. That means, it is a limited sacrifice that pays only for our past sins up until the time we are born-again.
God has designed Salvation and described it in scripture without a leak or a loophole in it. Only “ungodly people pervert the grace of our God into a license for immorality” (Jude 1:4). These ignoble proponents of Once Saved Always Saved (OSAS) theory have the audacity to even say, “sin like the devil, and you will not lose your salvation.” Their “condemnation was written about long ago” (Jude 1:4). What these people are peddling is the “doctrine of demons” (1 Tim 4:1-2) that was once upon a time fed into the ears of Eve, saying, “Ye shall not surely die” (Genesis 3:4).
That they were never saved to begin with, does not cut it. It’s a cop-out!
When we sin, God chastises us. As Brother Suri put it, “When we are judged, we are disciplined by the Lord so that we will not be condemned along with the world” (1 Cor 11:32). But there are many whose “consciences have been seared as with a hot iron” (1 Timothy 4:1-2). That is, their conscience–through which we get the promptings and the convictions of the Holy Spirit–is dead. For these, no amount of chastisement will avail anything. “To their loss they are crucifying the Son of God all over again and subjecting him to public disgrace” (Hebrews 6:6). Since they “sin willfully after having received the knowledge of the truth, there no longer remains a sacrifice for [their] sins” (Hebrews 10:26). They must pay for their own sins.
Paul says in Colossians 1:24:
“Now I rejoice in my sufferings for your sake, and in my flesh I am filling up what is lacking in Christ’s afflictions for the sake of his body, that is, the church.”
That Paul paid with his affliction what was lacking in Christ’s affliction goes to say there is no more sacrifice of Jesus left in their case. And since there is no forgiveness for sins without the shedding of blood (Hebrews 9:22; Leviticus 17:11), Paul had to step in with his own sacrifice for us. See also 2 Corinthians 4:10-12; Galatians 6:17; Philippians 2:17 where Paul again speaks of his payment for our sins. And yes, God gives some the unction to forgive sins in general (John 20:21-23). That is in fact the function of the office of the priest.
The Precursor kicks-in when we give into sinning knowingly and willfully, for which there is no more sacrifice–of Jesus or of the members of the Body–remaining to cleanse us of these willful sins (Hebrews 10:26) and receive forgiveness.
Therefore, i invented this Provision with the authority and Calling of Son of David/Immanuel given me. It is a Precursor to Baptism of Fire for the apostate as a remedy for that inescapable situation that one can potentially find himself in. This is more relevant now even as the Second Coming and the Judgement Day draws nigh.
As this “proceeds from faith” (Romans 14:23), those who follow up with the Precursor have shaved off their heads as a symbolic sign of confession and of pleading guilty that they deserve to burn in hell fire, beginning with their hair. They acknowledge that they are a type of Joshua, “a brand plucked from fire” (Zechariah 3:1-8; Jude 23). And just as Zacchaeus gave away half of his net worth (Luke 19:1-10), they may also make a freewill offering to the Church voluntarily. (All proceeds should go to take care of the poor, the sick, the widows, the elderly, the orphans, and for the glory of God, as decided & managed by the Church.) And according to the authority vested in a servant of God/priest/pastor (John 20:21-23), he may declare the absolution. But if it is a sin against a neighbor, restitution must first be made according to Matthew 5:23-24.
As questioned by Brother Zephaniah: How can we say that the Precursor is approved by God and is not a “strange fire” (Leviticus 10:1-3 KJV) or “unbiblical,” as also being asserted by Brother John Bishop?
Brother Newton Reginald and Brother John Bishop concur and say:
“God said that the wages of sin is death. People committing willful sin will have to face fire on the judgement day. Because God is going to come down second time not as a sheep but as a judge. No mercy anymore. God will forgive people who are unknowingly committing sin; HIS Blood on the Cross is the remedy for unknowingly sinning but no mercy for willful sinners.”
My answer is:
The novel Provision is made according to the Law and to the Testimony (Isaiah 8:20; cf. Matthew 13:52);
The Precursor “proceeds from faith,” both on the part of this Designer and those who perform it (Romans 14:23); and
It is in view of the inescapable situation (truth) that one who has sinned willfully finds himself in. As Brother John Phillip correctly points out, “Of course there cannot be another sacrifice but there has to be [a] forgiveness and cleansing,” i.e. a way out. The Precursor designed by this Son of David is the way out and an answer/solution when one becomes aware of his/her willful sin!

I have the eerie feeling that that person is me. Once upon a time i was indeed a “man of sin,” but now an adopted son of God and even a Son of David by decree. We Christians understand this cleansing very well even though many do not act as they do. But for Hindus, Jews and Muslims they will perhaps once again tear their robes and say: This sinner will be “doomed to destruction.” I believe God has those sticky verses in Bible so that only someone who is really and truly a god like Jesus based on what God Himself told him, could be brave enough to take his seat there in the Third Temple. If those verses were not present in the Bible, surely Trump, who claims to be the Chosen One, would have taken his seat there by now. (See Could American Evangelicals Spot the Antichrist?) But now that those uncomfortable verses are present in the Bible, and as Christ must rule the earth eventually, only the true Christ will have the guts to take his seat there in the Third Temple. In other words, the Throne of David is well protected! “Truth is so precious that it should always be attended by a bodyguard of lies” (Winston Churchill as cited by Ravi Zacharias).
In view of Injil/Gospel John 10:35 of the Bible, which by virtue of the sap/Holy Spirit/Rhema-Word indeed flowing to me directly from God, makes me a true god (a Son of God by decree & right—a part of יהוה/God/الله/ईश्वर/దేముడు) over and above any “so-called god or object of worship.” As for you, do not be among the “condemned who did not believe the truth (incl. my testimony that i am in communion with the Creator God) but had pleasure in unrighteousness” (2Thessalonians2:12 NKJV)–the unbelievers, who “crave” (Matthew 12:39) for signs and wonders such as a physical rapture.
Therefore, it is too simplistic to say: “It is the antichrist who will take his seat in the third temple ‘proclaiming himself’ to be God.” I ask: “Where then is room for the real Christ for whom we pray daily and ask God, saying, ‘Thy kingdom come and thy will be done on earth as it is in heaven’?”

In there👆🏾 i also share in simple language the design and architecture of the Third Temple–the “One New Man” (Ephesians 2:15).
Christ needs nothing from us but He rejoices in using simple things like mud, 5 loaves of bread and two fish, clothes for himself, etc. He does not need even a body. But He rejoiced to use Mary as a vessel for His birth. Likewise, he will use our gifts of technology for His glory.
My Callings:
Among many other titles, God has also called me “Immanuel” (god with us). You can’t get better than that!
As you can see, it is not me who exalts me. It is God who is exalting me! See Matthew 23:12.
As i very well know what delusions are by nature, and even wrote my autobiography with the subtitle, “At Crossroads with Faith & Delusions,” i have made a foolproof mechanism to ensure that it is good LORD Almighty God–someone external to me, not my own mind playing tricks on me–who is talking to me.

“For thrones are set there for judgment, The thrones of the house of David.” (Ps 122:5)
“He will be great, and will be called the Son of the Highest; and the Lord God will give Him the throne of His father David” (Luke 1:32)–a promise conferred to me twice by God.
Moreover, these three things the Jewish people believe is the mark of their Messiah, who will be one risen from among humanity and that which some Church leaders say is the mark of the antichrist:

As Son of David, Christ, Bridegroom, Lion + Lamb, Capstone, Son of God, and also being called Jesus by God, I had intended to come in glory as the genuine expected one with full credentials such as with a patented invention that can save the human race from the AI-Automation Beast, which has, over the years, taken both blue collar jobs and white collar jobs. But godless Patent Office in the United States and the godless US courts would not have it. They have perceived giving a patent (13/516,443) valued in billions of dollars for my invention as only benefitting the Indian economy at the expense of the US economy and have denied me a patent. When the Supreme Court of the United States (SCOTUS) declined to hear my case (Writ of Certiorari), I appealed to the US Congress as well as the President of the United States (POTUS). Now the combination of godless men and Artificial Intelligence will result in nothing short of death for planet earth. Therefore, this issue rises above domestic politics of the United States. It was none other than the Late Stephen Hawking who said, “Without a world government, technology will destroy us.”
Both Biden & Trump have shown themselves to be godless and base people. Therefore, they are both unfit to rule planet earth, which is what this US elections is all about in the day and age of Artificial Intelligence and the Internet. See PBS documentary on “In the Age of AI” by FRONTLINE and know that China is openly a surveillance state already. United States too and much of the world is under surveillance as well but currently in stealth mode, with “digital robber barons” having a field day. Now surveillance capitalism is trying to control the outcome of US elections. Actually, both the miserable parties, who are desperately wanting, are controlled by surveillance capitalism of their own for vested interests.
I appeal to all US citizens to die to their self-interest, “deny themselves,” and uphold the interests of the world-at-large, and do God’s will.

It has been almost 40 years since my brother Sudeep and I left DB. So it is fitting that I should share with you all, the most significant thing that happened to me since then. I converted to a Christian from being a Hindu/Agnostic person. This did not come easy. My parents and Motupalli family even built a Ram temple and a Shiva temple in Andhra and we were devout Ram bhakts. We as a family considered Jesus as the god of the Dalits and therefore stayed away from him for the most part. There was also this huge conversion debate going on in the country, raising our suspicion of an ulterior motive within Christians.
I wrote this letter to Prime Minister Modi:
“Before I was converted to a Christian, i never missed a single opportunity to steal, lie, fornicate, use filthy language, boast, quarrel, be arrogant, etc. And ALL whom i knew were such people. When i converted, i became a law-abiding citizen. That is what conversion is! Now, why would you want to persecute someone who converts people like me into law-abiding citizens when there is no such solution offered by Hinduism? It boggles the mind! Only a sinless brahman—Jesus Christ alone—can perform that yagna/sacrifice to pay the penalty for all our past sins. We know that Jesus succeeded in performing that yagna (swayam-bhali/self-sacrifice) because He rose from the dead. He is alive today as the living Holy Spirit. Therefore, Jesus alone, through his followers, happens to be offering this free gift of moksha/salvation to you and me. As a government official, who is looking after the welfare of the state, you ought to be encouraging MORE conversions, which make more criminals into law-abiding citizens. Take stock of this and you will see India shinning as the brightest star in the world. God bless you, your government, and God bless India.”
We all must face death one day. As we are in the midst of a pandemic and life is hanging in the balance, the Christian message of eternal life to those who place their trust in Jesus, who laid down His life for them, is therefore of so much importance and so relevant for the times. It is the sacred duty of all Christians to share this message to all who do not know it, even though we are kicked out of groups.
If you are thinking good people go to heaven, think again! The following is reason why good people can potentially go to hell:
If i mix even a tiny little crap in a clean cup of water, even though it is 99.99% clean, you will discard it, won’t you? So will God discard us if we harbor the guilt of just one wrong (sin). God is holy. He will not tolerate even a speck of sin in his presence. Only Jesus can pay all the penalty for all our sin and make us 100% clean and fit to enter heaven.
Romans 3:23 & Micah 7:2 from the Holy Bible reads:
“For all–good and religious people alike–have sinned and fall short of the glory of God.”
I have even shared this message to people like the Dalai Lama, saying it is not enough to be “good.” For good men too likewise perish. When we properly apply our goodness that we all do have partially, to recognize the one who is truly good, namely Jesus, we would be hitting a gold mine. He makes all those who put their trust in Him into good people indeed, having paid their penalty for them by shedding his blood. On the other hand we insult God if we don’t acknowledge the good that Jesus has done for mankind. We would be merely flexing our muscles and showing off our own good deeds, instead of recognizing God’s good deed of loving us so much and sending His Son to die for us on the cruel cross. Since we would be insulting God, we would perish in our conceit and self-righteousness.
This is the truth that I found and I share it with all my family and friends of my old schools and colleges. You are free to do whatever with it. But your destiny is now in your hands. The choice is yours! Receive the help of Jesus since there is no other help to come by from anywhere else. He alone died for us, to pay our sin debt. Be blessed! Love is never to be rejected!

[10:02 PM, 7/17/2020] Nitin Seshadri: Hi Suresh/Caleb. I will reply with a very few observations. First I am happy you have found peace & contentment with your conversion to Christianity. I wish you well in that. Second your world view is now coloured by Christian theology (which I respect). However I sincerely do not accept the theory that one sin makes a person unworthy, that everybody who isn’t a Christian is somehow lost, that all you knew were fornicators impure etc. I do not wish to debate theology here. All I can say is that if you had studied different religions you will realize that they take different paths to similar goals. Without getting into merits of the “none with sin can attain Heaven” concept let me say that I do not believe it, the religion that I practice does not believe it. People in my view are all fundamentally imperfect. It’s a weighing scale of Dharma that includes carry forward credits & debits that decides our future disposition. That belief system of mine is tempered with the knowledge that there are other beliefs (again which I respect). There is no point in further theological debate. With all due respect neither am I qualified nor at the end of the day are you. If there were 100% agreement on all aspects – forget other religions there wouldn’t be Catholics, Baptists, Methodists, Presbyterians, Latter Day Saints, Seventh Day Adventists etc. It’s because there are differences that there are different sects different religions.
I have read lots of portions of the Bible and although it isn’t my religion I will commend a particular line to you. John 14:2 :”In my father’s house there are many mansions”.
Enough said.

The Gospel Truth is simple. We are all sinners whether we admit it or not, whether our sin is this or that. We need a savior who pays our penalty. And Jesus fits that bill. Why reject help? Such a help of one laying down His life for us in love?
Everyone wants to think of himself as being on the right path. His culture, his ancestral religion, tradition, etc. It gives him head-weight. But it takes humility to admit that we are wrong and say that our opponent is right, if in fact he is of course.
But really appreciate you taking a shot at it, Nitin. You are the same great courageous debater that i know.

The water you drink is adulterated with dissolved salts, microbes etc. If they are deemed within a certain percentage water is deemed potable. Do you eat chocolate ? Or Atta ? Or Maida ? But if you ask me whether I will still have the appetite to eat the chicken after watching it being slaughtered – probably not. Imperfect analogy.

I challenge you to take this line of questioning: Have you ever said a lie? If you said “Yes,” what would that make you? Yes, a liar! Have you ever stolen anything from anybody? If you said, “Yes,” what would that make you? Yes, a thief! Have you ever lusted (desired uncontrollably) a member of the opposite sex? (Were your eyes looking at the wrong places?) If you have answered, “Yes,” what does that make you? Yes, you have already committed adultery with her! “Already” because our self is in our heart not beneath the skin. If we are human with a bit of conscience that should humble us and cause us to think of ourselves as doomed in the sight of a Holy and Almighty God. Dr. John Piper had written a book about the Corona Virus pandemic in no uncertain terms… as the judgment of God. We all know that when King David offered a sacrifice on the threshing floor on Mount Moriah to the Lord God, who is the maker of heaven and earth, the plague of his day ceased. So now that every world leader is fully cognizant of the real nature of this pandemic, i went to the Lord to ask him if i should now approach (write) the Israeli Ambassador in New Delhi for permission to go and offer a sacrifice on Mount Moriah in Israel, being that i am Son of David. And Jesus’ affirmative answer came from Matthew 8:4:
“Go, show yourself to the priest and offer the gift that Moses commanded, for a proof to them.”

Then i wondered what was it that Moses commanded for particular plagues to cease. And i found Numbers 16:46:
Moses said to Aaron, Take a censer, and put on it fire from the altar, and put incense on it, and carry it away quickly into the camp, and make atonement for them; for wrath is gone forth from the presence of the Lord, it has begun to destroy the people.
Then i asked the Lord if i should make this known widely. Insignificant as i am, currently, i wrote to Pastor John Piper. The answer from the Most High came from 1 Chronicles 16:
Oh give thanks to the Lord; call upon his name; make known his deeds among the peoples!Sing to him; sing praises to him;tell of all his wondrous works! Greetings in the name of the Lord Jesus Christ!
I am a citizen of India, who lived in the United States for over ten years for graduate studies and work.
In 1989, while i was still doing my master’s in Computer Information Science at NJIT, i conceived of the Necktie Metaphor Persona Extender invention, which has matured, and is today called Augmented Intelligence, Internet of Things (IoT), Augmented Reality, Wearable Technology, Christocratic NWO, and Big Data in its various forms in the marketplace of technology. I happen to be the inventor to all of these technologies, which are offshoots of the initial formulation in 1989.
Today, i am the CEO and Managing Director of AgapeJUST [P] Ltd., which is a hi-tech company, started in 2017 here in India, dealing with these technologies. The company hopes to start an operations HQ in the United States very soon and employ over five hundred high skilled people and even make every user of our technology an indispensable member of the workforce amidst the “automation beast” and even amidst Corona Virus. Per our solid business plan, we expect to touch revenue of over $1B by year 2025.
I am now appealing to the US Congress from the US Supreme Court’s denial of justice on my utility patent application for these inventions of mine.
Unfortunately, the inventions have now become public domain, where everyone, including Google, Microsoft, MIT Labs, Cisco, and IBM, are helping themselves to it, while a patent is denied this inventor.
The US national stage patent application no. 13/516,443 was filed in 2012. The application passed all the three major tests for patentability, namely, Eligibility (§101), Novelty (§102), and Non-obviousness (§103). However, the USPTO’s Examiner rejected all Claims under §112 Enablement requirement, primarily because he alleges that the Specification is not enabling to “a person having ordinary skill in the art” (PHOSITA) to make and use the invention. Applicant had argued that not only was the Patent Application assigned to the wrong technology center at the USPTO, but as the invention is interdisciplinary in nature, a single examiner from Artificial Intelligence art unit will not suffice for instantaneous enablement. At least two or three persons from relevant disciplines are needed for enablement of this interdisciplinary invention. The prosecution dragged on till the US Supreme Court.
On April 20, 2020 the court of last resort has denied my petition in my patent case No. 19-8094, titled:
Caleb S. Motupalli, Petitioner v. Andrei Iancu, Director, United States Patent and Trademark Office.
My case stands or falls over the Pre-AIA 35 U.S.C §112 ¶ 1 Enablement Statute.
The Supreme Court has maintained its “avoidance canon.” Instead of invalidating the Pre-AIA Statute and declaring it erroneous, it has simply denied the petition and avoided making a decision on it.
No doubt, “striking down a legislative act is the most momentously delicate thing a constitutional court ever does. The political costs of doing so can be great, and in any case, courts are often queasy about nullifying the work of a body whose democratic legitimacy seems more obvious and straightforward than their own. On the other hand, protecting citizens against unconstitutional legislation should make up a central part of a constitutional court’s raison d’être. By enjoining the Court to avoid statutory interpretations that would render a law unconstitutional, or even suspect, the avoidance canon purports to limit the use of the Court’s most fantastic power and to promote deference to the legislature.” (Appealing to Congress, Justin Collings, Law Review, Univ of California at Davis)
The US Supreme Court simply does not want to appear as ordering the legislature around. Therefore, it has simply denied my Petition without any opinion.
The challenged law, namely, Pre-AIA 35 U.S.C. 112 ¶ 1 Enablement, is erroneous(!) and perhaps even unconstitutional, and must be accepted as such by US Congress in view of the following rational:
35 U.S.C. §112 ¶ 1 (Pre-AIA) provides in relevant part (with the portion in square brackets [] added in the America Invents Act of September 2012):
“[In General,] the specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any (one) person(?) skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.”
The Statute requires that the specification of a patent application describe the invention in such terms that those skilled in the art are enabled to make and use the claimed invention. The purpose of this requirement is to ensure that the invention is communicated to the interested public in a meaningful way.
With current computer applications, it is not unusual for the claimed invention to involve two or more prior art areas, or more than one technology area. Typically, corporations have separate departments that deal in specializations, and are collectively enabled to make and use such inventions. It is also reason why patent offices elsewhere have three examiners examining a single patent application for maintaining objectivity. “Where different arts are involved in the invention, the specification is enabling if it enables persons skilled in each art to carry out the aspect of the invention applicable to their specialty.” In re Naquin, 398 F.2d 863, 866, 158 USPQ 317, 319 (CCPA 1968)). Also, “the Board stated appellants’ disclosure must be held sufficient if it would enable a person skilled in the electronic computer art, in cooperation with a person skilled in the fuel injection art, to make and use appellants’ invention.” In Ex parte Zechnall, 194 USPQ 461 (Bd. App. 1973). See USPTO’s own MPEP 2164.05(b).
The Federal Circuit Court had retroactively(?) applied Pre-AIA, which possesses this US Congress-acknowledged legislative drafting error, and shockingly overturned the aforementioned precedent (Naquin & Zechnall) by insisting that it be asingle person working alone having a single skill who must be enabled to make and use the full scope of the specification. See In re: Motupalli, No. 19-1889 (Fed. Cir. 2019).
Clearly, the 35 U.S.C. §112 Statute is in principle as well as per precedent fully satisfied when the specification of a patent application is enabling to an interdisciplinary team of two or three persons, working in cooperation, to make and use the claimed invention. That is, said PHOSITA, in addition to taking the form of a single person, can also take the form of a two-or-three-persons-PHOSITA, and still satisfy the §112 Enablement requirement.
The US Congress itself became cognizant of the above legislative drafting error and made amendments/corrections in the America Invents Act (AIA) of September 2012. However, since my application had a filing date of June 2012, the Federal Circuit applied Pre-AIA and disqualified my patent application from the benefits of the amendment to the §112 Statute that came with the AIA.
This retroactive application of Pre-AIA by the Federal Circuit is clearly erroneous because the US Congress itself made the pertinent amendment by qualifying the Statute with the phrase, “IN GENERAL,” which was prefixed to ¶ 1 of the Statute. The amendment now allowed for exceptions such as a team of two-or-three-persons-PHOSITA, who would need to be enabled by the disclosure. Though it was clear that the Pre-AIA Statute has this legislative drafting error, the court refused to apply legislative intent that conflicted with the Pre-AIA text of the law. Instead of deferring to the Legislature, the court should have taken the high ground and invalidated the Pre-AIA Statute from being applied retroactively. The Federal Circuit preferred applying the Pre-AIA Statute even though the legislative intent of the Statute itself pointed in the other direction, and even though it was actually corrected by the US Congress in the AIA. The Federal Circuit’s retroactive application should have been struck down at least by the court of last resort–the US Supreme Court. Appellant had hoped that in the interest of justice the Supreme Court would make a favourable decision on it. But it denied the Petition.
The US republic has a rich history, a noble goal, and is magnanimous. Appellant therefore appeals to the higher virtues present in the United States Congress.
In conclusion, the Appeal to US Congress can be summarized as:
Even though the US Congress made corrections to the 35 U.S.C §112 Statute in America Invents Act, the Federal Circuit Court has shockingly overturned precedent (Naquin & Zechnall) and said the erroneous Pre AIA Statute applies for my case since my application falls 3 months before the Amendments to the law, took effect. Apparently, its hands were tied. And the US Supreme Court avoided making a decision on it, deferring the case to the legislature.
This retroactive application to an erroneous Pre-AIA law is also erroneous.
Since the AIA already has the requisite amendment/correction in place for the §112 Statute, now it is just a matter of ordering that:
The Pre-AIA not be applied retroactively in this case because the intent of §112 Statute is self-evident that allows for a team of two-or-three-persons-PHOSITA for ensuring that the interdisciplinary invention is communicated to the interested public in a meaningful way, as even the precedent declares; and
USPTO reopen prosecution of my patent application or better still, outrightly allow all Claims.
